How should the Supreme Court decide the dental examiners case?

Today I’ll continue talking about the doctrine of immunity from federal antitrust law for “state action”, in the context of the Fourth Circuit’s North Carolina Board of Dental Examiners v. FTC opinion. (See Monday’s post for an introduction to this doctrine, and see Tuesday’s post for the facts of the dental examiners case.) On Wednesday I discussed the three different approaches taken by various circuit courts to this issue.
